Spanish Fiscal Residence

If you have applied to be a fiscal resident of Spain it is important to keep in mind the different ways in which this status is treated for taxation purposes.
 
If you have been here for a full year, you may be treated as a Spanish fiscal resident. If you have been here for less than a year, it is dependent upon a 6 month milestone.
If you have been here for over 6 months, you may be classified as a Spanish fiscal resident. If you have been here for less than 6 months, you shall not be classified as a Spanish fiscal resident.
 
You obtain Spanish Fiscal Resident via the issuing of a Spanish Tax Record Certification.

Under existing law if you are working in Spain you are required to file an income tax declaration every year.

Furthermore, if you are an owner of property in Spain (regardless of whether you work in the country or not) you are also required to file an income tax declaration.

If you live and work in Spain you are required to file an income tax declaration always.

If you are a non-resident, then you are expected to file as a non-resident. While you will only to have to pay non-resident taxation in Spain, you are usually still obliged to make an income tax declaration in your nation of domicile.
